The best interest principle of the child shall be of paramount importance in every matter that concerns the child according to the reflection in section 28 (2) of the Constitution. The importance of the idea behind the best interest of the child that is paramount to acknowledge that children are more physical and psychological vulnerable than adults and require a different treatment from adults when in conflict with the law. The Child Justice Act 75 of 2008 envelops the criminal procedure pertaining child offenders, among other arrest, placement procedure or process, and sets out the appropriate sentence or clarify procedural issues that are associated with sentencing and critically consider the role and voice of the victim in a crime committed by the child offender, which is markedly different from the previous system regulated by the Criminal Procedure Act 51 of 1977.
